David Jenkins

GENERAL OVERVIEW

David Jenkins is a specialist in the resolution of complex civil disputes. During the past twenty-four years, Mr. Jenkins has successfully mediated in excess of 3,000 multi-party, factually-complex disputes in over 44 states, including the Eastern and Western Seaboards. During this time he has managed a diverse dispute resolution practice incorporating, but not limited to: Design Errors and Omissions, Construction Defect, Course of Construction, Breach of Contract, Changed Site Conditions, Product Liability, Insurance Coverage, Real Estate, Intellectual Property, Professional Malpractice, Industrial & Advertising Injury and Employment cases in both North & Latin America and he has frequently served as a court-appointed Special Master and Settlement Referee.

As Educator/Trainer

Mr. Jenkins entered the field of dispute resolution in the late ’70s when the field was first inventing itself. Educated as a trainer in Organizational Development, Mr. Jenkins has, since, designed/administered court-annexed mediation and dispute management programs for over eight hundred Corporate & Public entities, including organizations as diverse as: the Oakland Police Department, Dames & Moore, the Sugar Workers Union & C& H Sugar, Motorola and the Argentine Ministry of Justice. Since 1982 and while introducing  mediation as the procedure of choice for the early resolution of multi-party civil disputes, Mr. Jenkins has designed/conducted extensive training courses for insurance professionals and Claims Managers throughout the continental U.S. A partial list of participating insurance companies who have participated includes: Aetna, Hartford, CNA, Kemper, Travelers, Design Professional Insurance Company, Industrial Indemnity Company, Liberty Mutual, Fireman's fund, Chubb, Maryland Casualty and RAMCO.  Mr. Jenkins is fluent in Spanish and has enjoyed the privilege of being one of the first ADR Professionals to introduce mediation procedures in Latin America, working in concert with the USIS, the USAID, the Ministerio de Justicia de Argentina, the Centro de Estudios Judiciales de Uruguay and the Chamber of Commerce of Guadalajara, Mexico with whom he has collaborated to introduce mediation into Latin America. He is currently designing an advanced training & certification series to benefit the developing ADR sectors in these countries.

Mr. Jenkins is a frequent speaker for legal and professional organizations, businesses and universities including: the Bar Association of San Francisco (Insurance Practice Section, re: "Insurance Coverage Issues in Construction Mediation)" as well as, the New York State Bar Association (New York City & Rochester) on “How To Settle A Commercial Case.” He has designed and provided 40-hour "Mastering Mediation" curricula for the many venues including the Marin County Bar Association, "The (L.E.A.P. protocol) “Least Expensive, Acceptable, Permanent Repair” Strategy for the West Coast Casualty Annual Construction Defect Seminar and has provided seminars on the use of mediation for the resolution of disputes internal to organizations including a seminar on “Conflict Resolution in a Team Environment" at the Kaiser P. Medical Group, Chief's Forum in Oakland, California.
